Couple settle secretly over wind farm case at High Court
A COUPLE who claim the noise generated by turbines drove them from their farmhouse home have settled a High Court damages action against the owners and operators of a wind farm.
Julian and Sarah Davis, of Grays Farm, in Deeping St Nicholas, launched a claim and an injunction against defendants including Fenland Windfarms and Fenland Green Power Co-operative after moving out of their home in December 2006, six months after the eight-turbine windfarm half a mile from their home began operating.
The long-running hearing was due to resume yesterday, but trial judge Mr Justice Hickinbottom was told that a settlement had been reached with the Davises and that the details of the settlement would be kept “strictly confidential”.
They had originally requested a modification of the operation of the wind farm plus £400,000 damages; or an alternative “like for like” replacement of their farmhouse which they value at £2.5 million.
Both sides said in a joint press release: “The terms of that settlement are strictly confidential. The parties will not be answering any questions about the terms of that agreement.”
