Inside Justice Week: You be the judge - The ET is asking you to decide the sentences of the defendants in three cases John Smith (22) is arrested close to Peterborough Railway Station at 9pm one May evening.

The police have been observing him for some time as he's been slowly pacing up and down the same road leading up to the station entrance.

When questioned, he says he's "waiting for a mate". Smith agrees to be searched.

Police found a bag containing six large rolled-up cigarettes in a plastic bag in the bottom of his rucksack and 20 cash.

When asked what the cigarettes are he says they're "joints to share with some mates later that night".

He's arrested and taken to Thorpe Wood police station where he's locked in a cell until police have enough information to interview him.

During the interview he repeats what he told police during his arrest.

He denies that any of the money in his possession came from selling joints. He's released on bail at 3am the next morning to return to the police station in early June.

An analysis of the cigarettes shows that each contains cannabis resin, totalling half a gram.

Smith is charged with possession with intent to supply class C drugs and bailed to attend Peterborough Magistrates' Court in June.

Smith pleads guilty.

He has no previous convictions and has just completed a training course and started work as a trainee electrician. He takes home 150 a week and lives with his mother, who he gives 30 a week towards his keep.
